
The U.S. Environmental Protection Agency (EPA) universal waste program streamlines the hazardous waste management standards for certain categories of hazardous waste that are commonly generated by a wide variety of establishments. These regulations apply to five types of universal waste: batteries, pesticides, mercury-containing equipment, lamps and aerosol cans.
The Environmental Protection Agency (EPA) signed the final Hazardous Waste Generator Improvements Rule (HWGIR) on Oct. 28, 2016, and it was published in the Federal Register (FR) on Nov. 28, 2016.
The rule improves the entire hazardous waste generator program to strengthen environmental protection while ensuring businesses have the flexibility and certainty they need to successfully operate.
The Aerosols as Universal Waste Rule went into effect on Feb. 7, 2020. Because adding aerosols to the universal waste program makes the Resource Conservation and Recovery Act (RCRA) regulations less stringent than they were before, states are not required to adopt the new rule. However, we believe most, if not all, states will ultimately adopt the Aerosols as Universal Waste Rule.

The U.S. Environmental Protection Agency (EPA) is ending the enforcement discretion policy it put into place in March in response to the COVID-19 pandemic. On Aug. 31, 2020, the EPA will return to pre-COVID enforcement guidelines, and any non-compliance from that point on will not benefit from the discretionary terms of the temporary policy.

In the past, correction letters have been an acceptable method for issuing corrections to the manifest after the treatment, storage and disposal facility (TSDF) received the shipment. While a correction letter can still be used for manifests generated prior to June 30, 2018, they are no longer required or necessary for any manifest generated (paper or electronic) after that date. As we reported back in November, the Office of Management and Budget (OMB) has released a Final Rule for the Management Standards for Hazardous Waste Pharmaceuticals. It is anticipated that the EPA will now publish the final rule by the end of 2018. The Office of Management and Budget (OMB) has released a Final Rule for the Management Standards for Hazardous Waste Pharmaceuticals. The EPA will now publish the Final Rule by the end of 2018. Eight volunteers from Clean Earth were at Oros park on Omar Avenue on September 24, 2018, clearing the Woodpecker Trail of the two trees that had fallen months ago. They also extended the trail by about 100 ft., then cut back overgrown areas around Pat’s Pond and the pond trail as well. It took them several hours of hard work to get it all done. DART has a RCRA Part B Hazardous Waste TSDF strategically located in Charlotte, North Carolina and a Waste Water Treatment facility in Detroit, Michigan. The United States Postal Service (USPS) is looking to modify regulations for its Merchandise Return Service (MRS), which is used for several mailback products offered by Clean Earth. As previously shared, the EPA’s new hazardous waste e-Manifest system went live on June 30, 2018. The registration process is now functional for industry users and generators – those who produce hazardous waste – to create accounts to access the e-Manifest system and data. All manifests signed by generators on June 30 and after are required to be submitted to the e-Manifest system. Some of these regulations have changed since we last reported about the e-Manifest, including the provisional fee structure. Multiple states are adopting federal commercial driving regulations set by the Environmental Protection Agency (EPA), Federal Motor Carrier Safety Administration (FMCSA) and Pipeline and Hazardous Materials Safety Administration (PHMSA). Others are deleting provisions that were more stringent or different from federal commercial driving regulations. While we’ll continue to monitor the progress as legislation moves forward, here are the current states that have approved federal commercial driving regulations: As states and territories continue to analyze the Hazardous Waste Generator Improvements Rule, we are continuing to monitor their latest rulemaking activity. West Virginia became the latest state to put the rule into effect as of June 1, 2018. Below is the most recent anticipated schedule of states and territories adopting the Hazardous Waste Generator Improvements Rule: On May 9, the EPA issued its “unified agenda,” which included the statuses of all regulations in process. Previously, the Hazardous Pharmaceutical Waste Rule was scheduled to be finalized in July 2018. Following the agenda, the latest target for finalization is October 2018. The rule would work to remedy the compliance difficulties some healthcare facilities have when discarding hazardous waste, including: Aerosol cans are broadly used for dispensing a variety of products including personal care items (like hairspray and sunscreens), cleaners, food items, paints, pesticides, and many more. It’s estimated that 3.82 billion aerosol cans were filled in the U.S. in 2015 for commercial, industrial, and household use. Clean Earth, Inc. announced today the acquisition of privately owned ESMI Companies located in Fort Edward, New York, and Loudon, New Hampshire. The EPA issued a new letter clarifying how the Resource Conservation and Recovery Act (RCRA) regulations apply to the recalled Takata airbag inflators that are subject to the 2015 Preservation Order issued by the U.S. Department of Transportation (DOT). Here are three of the latest hazardous waste regulations updates to be aware of in October 2017. While most state legislatures are out of session at this time, New Jersey and South Carolina are two of the latest U.S. states to move forward with pharmaceutical legislation. New Jersey: Passed legislation, effective October 19, 2017, that allows hospice care programs to accept unwanted prescription medication from patient/resident no longer in their care and can dispose of medications appropriately. Hospice must create written programs and communicate the program to their patients. Clean Earth Connect provides: It is no secret that aerosol cans are ubiquitous in today’s society. According to the Consumer Aerosol Products Council, up to 1,500 kinds of products, from asthma inhalers to shaving cream and hair sprays, are packaged as aerosols. Legislation addressing various pharmaceutical issues is moving forward in six U.S. states. Several new bills have passed in sessions and are in the process of being enacted, awaiting governor signature or are awaiting final enactment dates. Georgia, Utah and West Virginia are the latest states to host public hearings on the Hazardous Waste Generator Improvements Rule and request comments. The deadlines for these states are as follows: As states continue to place a focus on unwanted medication collection policies, three additional states have recently moved forward with legislation regarding various pharmaceutical issues and takeback programs. The National Association of Chain Drug Stores and RILA asked the EPA to reclassify products with low levels of nicotine during a public meeting held May 9, 2017 by the EPA’s Office of Land and Emergency Management. While testifying individually, both organizations asked the EPA to reclassify nicotine products as non-acutely hazardous wastes, noting that consumers can dispose of low-concentration nicotine products such as nicotine gum, lozenges, patches, prescription liquids and e-cigarettes. The New York State Department of Environmental Conservation (DEC) recently announced the following two initiatives to help retail pharmacies prevent violations and protect public health and the environment. On April 19, 2017, the Department of Transportation’s Pipeline and Hazardous Materials Safety Administration (PHMSA) issued a final rule revising the maximum and minimum civil penalties for a knowing violation of the Federal Hazardous Material Transportation Law. On October 28, 2016, Environmental Protection Agency Administrator Gina McCarthy signed the final Hazardous Waste Generator Improvements Rule intended to provide more clarity and flexibility to businesses. This acquisition will add four additional processing facilities and a vast array of additional technologies, services, and new markets to Clean Earth’s portfolio. In September 2016, the U.S. Food and Drug Administration (FDA) implemented a ban on 19 chemicals typically found in over-the-counter antibacterial soaps, including the most commonly used ingredients – triclosan and triclocarban. Manufacturers were ultimately unable to demonstrate that the ingredients were both safe for long-term daily use and more effective than plain soap and water in preventing illness and the spread of certain infections. Extended Producer Responsibility (EPR) refers to the policy approach under which producers are given a significant responsibility for the treatment and/or disposal of post-consumer products. Some bills are still in the very early stages, but the following states are considering the implementation of EPR programs: On January 30, 2017, President Trump introduced an executive order intended to reduce regulation and control regulatory costs. The executive order requires federal agencies to identify two prior issued regulations for elimination for every one new proposed regulation. In other words, whenever an executive department or agency proposes a new regulation, it must identify at least two regulations to be repealed.
